Victorian Coroner resigns despite being cleared of stealing alcohol

Victorian judge Sara Hinchey has formally resigned as the State Coroner despite being cleared of taking alcohol from her workplace for personal use.

In a statement released on Tuesday, Judge Hinchey said she would continue with her work as a judge at Victoria's County Court after tendering her resignation as State Coroner to Attorney-General Jill Hennessy on Monday.

Judge Hinchey stood aside as head of the Coroners Court almost 12 months ago after a detailed complaint about her alleged conduct and treatment of staff was lodged with the Judicial Commission of Victoria.

In a drawn-out process, the commission decided not to examine allegations of bullying and other staff complaints against Judge Hinchey. Instead, it focused on the allegation she had taken alcohol purchased using the court's funds for personal use.

Judge Hinchey has always maintained her innocence in the face of the strong accusations, and the alcohol complaint was dismissed by the commission after a specially convened panel heard the matter last week.

Judge Hinchey said that despite being cleared, the complaint "exposed philosophical differences about the direction which the Coroners Court should be taking".

"I am proud of my work as State Coroner and have immensely enjoyed performing my duties," she stated.

"Throughout my tenure I put in place a much-needed focus on community education, improved the efficiency of case management, sought to address the health and wellbeing issues that arise for staff at the court due to the effects of vicarious trauma and worked closely with the government to plan for future resourcing."

The Andrews government this year appointed Caitlin English as acting State Coroner.

WorkSafe Victoria is investigating alleged health and safety breaches at the Coroners Court during Judge Hinchey's tenure.
